Miller Mayer attorney Adam Schaye recently received an approval of an I-526 petition for an EB-5 immigrant investor that was initially denied but later reconsidered following a successful appeal. Miller Mayer filed an appeal of the denial and later filed a mandamus action in federal court when the appeal was taking too long. Immigration cases can take a long time. The U.S. Citizenship and Immigration Services (USCIS) often takes two years or longer just to decide an I-526 petition, the first step in the EB-5 immigrant investor process.
Sometimes cases just take too long, or USCIS loses track of a case. In this recent case, Miller Mayer successfully sued in federal court on behalf of our EB-5 client. After the complaint was filed, the USCIS approved the appeal and the EB-5 I-526 petition.
