On January 27, 2020, the Supreme Court voted 5-4 to allow the Trump administration to implement a rule to deny green cards to certain immigrants who use public benefits like Medicaid, food stamps, or housing vouchers. The Court did not rule on the merits of the new rule; it merely lifted court orders that had blocked the rule’s implementation. Challenges to the merits of the new rule will continue in various federal courts.
The Court’s ruling is causing confusion for immigration attorneys and their clients. As of January 28, U.S. Citizenship and Immigration Services and the State Department have not stated when they will start enforcing the new rule.
