Recently, media reports began to surface indicating that the Trump Administration’s regulatory agenda would include an effort to restrict H-1B extensions beyond the six-year limit. USCIS spokesman Jonathan Withington has confirmed that “…USCIS is not considering a regulatory change that would force H-1B visa holders to leave the United States by changing our interpretation of section 104(c) of AC-21, which provides for H-1B extensions beyond the 6 year limit.”
Under the American Competitiveness in the 21st Century Act (AC-21), H-1B status may be extended beyond the six-year limit, so long as certain benchmarks toward permanent residence have been met.
