L-1A status allows companies with foreign offices to transfer foreign employees into managerial or executive positions in the United States. USCIS has taken an increasingly restrictive approach to L-1A adjudications, with denial rates increasing roughly 9% over 2017. Despite these trends, Miller Mayer immigration attorney David Wilks obtained L-1A status for a manager at a multinational shipping company and an executive at an international investment firm. Particularly notable is that Dave was able to obtain L-1A status for the investment executive without a Request for Evidence (“RFE”). As of the fourth quarter of 2017, nearly 40% of all L-1A petitions received an RFE.
