The NIW petition must be accompanied by proof the individual holds at least a master’s degree (or a bachelor’s degree and 5 years of progressive experience) plus proof that the individual meets the follow criteria: (1) the proposed endeavor has substantial merit and national importance; (2) the individual is well-positioned to advance the proposed endeavor; and (3) the proposed endeavor is beneficial to the U.S. and thus merits wavier of the normal PERM labor certification.
