9th and 4th Circuits Grant Government’s Motion on Public Charge Rule

On December 5, 2019, a three judge panel on the 9th Circuit Court of Appeals voted 2-1 to grant the government’s motion for an administrative stay of the public charge rule injunction pending appeal. On December 9, 2019, a panel of the 4th Circuit Court of appeals similarly voted 2-1 to stay the public charge injunction in that case. However, the nationwide injunction granted in New York remains in place for the moment.

These cases challenge whether the government can limit immigrants’ access to certain federal benefits. The outcome will affect every potential immigrant – employment or family based – and will radically change who can and cannot come to the United States.
